1. Agreement to Terms and Conditions
   The Gold Coast International Hotel website is offered for use conditional upon acceptance by the user (you) of the terms and conditions set out below. Use of this website constitutes agreement by you to all such terms and conditions.
2. Changes to Terms and Conditions
   Gold Coast International Hotel reserves the right to vary any or all of these terms and conditions at any time without notice. Continued use of and/or access to this website subsequent to any variation of these terms and conditions constitutes agreement by you to the terms and conditions as varied.
3. Warranties by User
   The reservations facility contained on the Gold Coast International Hotel website is provided in order to make available details of accommodations and other services provided by Gold Coast International Hotel and to allow the making of legitimate reservations and for no other purpose.
   You warrant that you possess the necessary legal capacity to enter into this agreement and that all information provided by you is true and accurate. You agree that you will use the reservation facilities only for the purpose of making or inquiring about legitimate reservations in respect of yourself or others for whom you are authorised to act.
   You warrant that you are the owner of the credit card nominated in your booking details or are otherwise authorised to charge all fees and charges associated with any reservations taken by Gold Coast International Hotel to the credit card.
4. Non-Commercial Use
   Gold Coast International Hotel website is for your personal, non-commercial use. You may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or services found on, or obtained from, the Gold Coast International Hotel website.
5. Limitation of Liability
   The materials found on the Gold Coast International Hotel website are provided as is without any express or implied warranties, representations or undertakings of any kind, including but not limited to merchantability and fitness for a particular purpose, other than those warranties which are imposed by and incapable of exclusion or restriction under the laws governing this agreement.
   Gold Coast International Hotel does not warrant the use of the Gold Coast International Hotel website will be uninterrupted or error-free nor does it warrant the accuracy or completeness of the information, text, graphics, links or other items contained on the Gold Coast International Hotel website and reserves the right to make such changes and/or improvements at any time.
   You agree that use of the Gold Coast International Hotel website is at your own risk. Under no circumstance is Gold Coast International Hotel and/or its related entities be liable for any loss or damage arising, directly or indirectly, out of or in any way connected with the use of this website or with the delay or inability to use this website or for any information, products or services obtained through this website.
6. No Guarantee of Availability
   Submitting your booking details online does not guarantee you a booking in accordance with your request. No contract exists between you and Gold Coast International Hotel for the sale of accommodation or other services unless and until Gold Coast International Hotel accepts your booking and confirms your reservation by sending an e-mail to your nominated e-mail address which contains your reservation number.
7. Online Reservations
   By submitting your booking details online you are agreeing that your credit card will by charged for the full amount of your reservation when your booking is accepted by Gold Coast International Hotel.
8. Cancellations
   You may of course cancel your reservation but the cancellation of any booking made online will be in accordance with Gold Coast International Hotel's cancellation policy and made attract a cancellation fee. All cancellations must be received by the hotel 24 hours prior to 6pm on the day of arrival to avoid cancellation charges. Cancellations received after this time will incur a cancellation charge equivalent to the first nights accommodation. Failure to cancel reservations will result in the forfeit of all monies paid.
   
   **Please note that a different cancellation policy may apply for Special Events, Conferences or Promotional rates.
   • Indy Package
     For bookings on our Indy Package the following cancellation conditions apply: Cancellation after 1 August 2008 will forfeit one night’s accommodation revenue. Full cancellation applies for any booking cancelled after 1 September 2008.
   • Peak Season (26 December 2008 – 11 January 2009)
     For bookings over our Peak Season (26 December 2008 – 11 January 2009) the following cancellation conditions apply: Cancellations within 14 days of the arrival date will forfeit the first night’s accommodation revenue.
9. Links to Other Websites
   Gold Coast International Hotel website contains links to other Internet sites and resources. Gold Coast International Hotel is not responsible for the availability of these outside resources or their contents, nor does it endorse, nor is it responsible for any of the contents, advertising, products or other material on such sites.
   Under no circumstances shall Gold Coast International Hotel be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by use of or reliance on any content, goods or services available from such sites, or as a result of use of any information you provide to such sites. Gold Coast International Hotel is not responsible for the accuracy, copyright compliance, legality or decency of any material contained in sites owners and operated by third parties Any concerns regarding any external link should be directed to its respective site administrator or web master.
10. Prohibited Use
    As a condition of your use of the Gold Coast International Hotel website, you warrant that you will not use the website for any purpose that is unlawful or prohibited by these terms and conditions.
    Without limiting the foregoing, you agree that you will not use any device, software or other instrumentality to interfere with or attempt to interfere with the proper working of this site, and that you will note take any action that imposed an unreasonable of disproportionately large load on our infrastructure.
11. Severability
    If a provision of this agreement is void or unenforceable it must be severed from this agreement and the provisions that are not void or unenforceable shall remain in full force and effect.
12. Governing Law
    This agreement shall be governed by and construed in accordance with the laws of Queensland and each of the parties hereby submits to the non-exclusive jurisdiction of the Queensland Courts.
